Maryland State Trooper, Tanner Leroy Nickerson, was arrested on Sunday, August 13th 2017 at 9:02 p.m. for driving under the influence of alcohol, driving while impaired and four other related traffic offenses. Court records indicate that Nickerson was operating a 2013 Chevy Tahoe when the accident occurred Northbound at 291 N. Bohemia Avenue in Cecil County Maryland. The State Police have said the Chevy Tahoe is a State Police issued vehicle.

The Maryland State Police and local media announced that Nickerson had been arrested for drunk driving in Cecil County Maryland. The Maryland State have identified the driver as Trooper first class Tanner Nickerson, a six-year veteran of the force.
Reports indicate that the trooper rear-ended another vehicle while driving an off-duty state police vehicle, it’s not uncommon for Troopers to take home a state vehicle when off duty.
The trooper has been charged with six separate violations of the Maryland Transportation Code including driving under the influence of alcohol, driving under the influence of alcohol per se, and driving while impaired.
The Vehicle Struck by the Trooper
The Maryland State police have indicated that Trooper Nickerson ran into the back, or rear-ended, a Mercedes driven by a 49-year-old female from Cherry Hill, New Jersey. Also in the Mercedes was the woman’s 10-year-old child. Both individuals in the Mercedes were taken to Union Hospital, in Elkton Maryland, by ambulance for minor injuries. The State Police report that the trooper did not suffer any injuries.
Exact DUI and DWI Charges in Cecil County
Court documents show that the investigating agency was the Maryland State Police and charged their co-worker with six separate code violations including negligent driving, reckless driving, DUI, driving under the influence per se, driving while impaired, and failure to control speed to avoid a collision.
The negligent, reckless and failure to control speed do not carry the potential for jail time, however the DUI and DWI charges do.

DUI Penalties in Maryland
If convicted of the maximum sentence for driving under the influence, the Trooper it’s facing a maximum penalty if 1 year in jail and or a $1,000 fine, if this is his first offense. It is likely that the case will be heard in the Cecil County District Court within the next 30 to 60 days.
Trooper Nickerson will first appear before a District Court Judge and must make a decision whether to enter into a plea bargain or elect a bench or jury trial.
Jury Trial for a Maryland DUI or DWI
If the trooper elects a jury trial, the case will be heard in the Circuit Court for Cecil County. In order for the State’s Attorney to prove their case, they must prove beyond a reasonable doubt that the Trooper was 1) driving or attempting to drive a vehicle on a state highway and 2) that he was under the influence of alcohol or impaired by alcohol or drugs at the time of the operation.
This isn’t the first time a Trooper has been arrested in America for DUI. Back in 2016, a Pennsylvania State Trooper was arrested for drunk driving.
License Suspension for the Trooper
In addition to the judicial sanctions, the Trooper may be facing administrative penalties depending on the results of the breath test taken at the barracks. If Trooper Nickerson submitted to an alcohol concentration test and returned results of .08 or more, the Maryland Motor Vehicle Administration may impose a suspension of his driver’s license. We do believe that he submitted to a test because he was charged with the per se violation.
