There are two main differences and they both based on the amount of marihuana the police seize during the arrest. If the police arrest a Defendant and they have less than 10 grams then that person can be charged with the lesser offense. This means the maximum penalty is 90 days or $500 fine or both. If the police charge the Defendant with possession – marijuana 5-601(a)(1) then the maximum penalty if 1 year or $1000.00 fine or both. There is also a difference in procedure if a Defendant is convicted of the offense less than 10 grams. If you are convicted of less than 10 grams then you have an appeal right and your sentence is immediately stayed pending the appeal. That means that if you are incarcerated after the conviction, as soon as the appeal is filed in the District Court, then the sentence does not have to be served pending the appeal to the Circuit Court.
