The Maryland Transportation Authority Police (MdTA) reported that on September 29, 2014, they stopped a white 2014 Land Rover for speeding on I-95, behind the wheel of that vehicle was Mr. Phelps.
What Michael Phelps Can Expect from this DUI Arrest
Mr. Phelps has been arrested for DUI in 2004 in Wicomico County, Maryland, where he was granted a probation before judgment. The screen shot below is the CJIS information from the 2004 arrest and prosecution:
It is likely that Mr. Phelps will be facing the new DUI charges in Baltimore City, Maryland District Court based on the location of the traffic stop. Baltimore City is known as a tough jurisdiction when it comes to 2nd time DUI arrests.
Mr. Phelps will probably receive a trial date within the next 30 days and will have to appear in the Baltimore City District Court located on Patapsco Avenue.
Because the 2004 DUI occurred within 10 years of this most recent arrest, Mr. Phelps will not be eligible for a Probation Before Judgment (PBJ).
DUI Penalties in Maryland
Since this is a second DUI arrest and if convicted he could be facing enhanced penalties. If he is convicted of the DWI he is facing up to 1 year in jail and/or a $1,000.00 fine. If he is convicted of the more serious DUI, he is facing an enhanced penalty of 2 years in jail and/or a $2,000.00 fine.
When he was stopped he was asked perform Field Sobriety Tests. Based on the arrest, he was also asked to submit to a Blood or Breath test. If refused to submit to the tests or performed poorly on those tests, his privilege to drive could be suspended or he may be required to install an ignition interlock device on his vehicle.
