Difference Between DUI and DWI in Maryland

First off, lets break down the difference between a DUI and a DWI in Maryland.  DUI is the more serious charge and stands for Driving While Under the Influence.  DWI is the less serious, but still carries the possibility of jail time and is an acronym for Driving While Impaired.

DUI charges are filed against a driver when the police officer believes the blood alcohol content of the driver is .08% or more.  If the officer believes that the driver’s blood alcohol content is less than .08% or does not have a test indicating that, then the office will charge the DWI.  In most cases, the police officer will charge both the DUI and the DWI.  They want to have that as an option when the case goes to trial and a Judge or Jury can find that there is evidence the driver is under the influence or impaired.
