I was fortunate to represent a client today that was charged with the above charges in the District Court in Maryland.  The facts of the case were the client was driving to work when a police officer pulled up next to the client.  The officer had a LPR (License Plate Reader) mounted on his car.  The officer’s LPR alerted that the owner of the vehicle possessed a suspended driver’s license in Maryland.  The officer pulled next to the client and was able to identify the client from his MVA photograph.  The officer pulled the client over and informed the client that he was suspended for not completing his DIP (driver’s improvement program).  The client had no idea and never received notice that his license was suspended.  The client did receive notice in the mail 4 days after the traffic stop that he was suspended.  The client immediately completed the DIP and was able to obtain his valid driver’s license. The client had an envelope from the MVA showing that they did not mail the notice till after the stop.  I was able to present that evidence in trial as well as the testimony of the client that he did not have notice that he was suspended.  The Judge agreed and the client was found not guilty of all charges.

For a First Offense:

  • Penalty for violation of 16-303 (a) Driving on Suspended License: Maximum of $1,000 fine or 1 year in jail, or both.
  • Penalty for violation of 16-303 (b) Driving on Canceled License: Maximum of $1,000 fine or 1 year in jail, or both.
  • Penalty for violation of 16-303 (c) Driving on Suspended License Generally: Maximum of $1,000 fine or 1 year in jail, or both.
  • Penalty for violation of 16-303 (d) Driving on Revoked License: Maximum of $1,000 fine or 1 year in jail, or both.
  • Penalty for violation of 16-303 (e) Driving License Canceled by Other States: Maximum of $1,000 fine or 1 year in jail, or both.
  • Penalty for violation of 16-303 (f) Driving on License Suspended by Other State: Maximum of $1,000 fine or 1 year in jail, or both.
  • Penalty for violation of 16-303 (g) Driving on License Revoked by Other State: Maximum of $1,000 fine or 1 year in jail, or both.
