What does “failure to comply suspension” mean?  Failure to comply suspension means an individual has not complied with a court order or failed to pay a fine or fee to a District or Circuit Court in Maryland and that Court has notified the MVA (Motor Vehicle Administration) to suspend your privilege to drive in Maryland.

What does Failure to Comply Suspension Mean?

Failure to comply suspension means a person has failed to pay a fine or comply with an order of the Court and the Court has notified the MVA and directed the MVA to suspend that person’s privilege to drive. The MVA will typically notify the driver by U.S. mail that their driving privilege will be suspended on a certain date.

Failure to Appear Suspension

What does failure to appear suspension mean?  This is different than a failure to comply suspension. This is entered by the Court when you fail to appear (FTA) for a trial date. For example, you receive a speeding ticket and you requested a waiver hearing or trial. By the way, you should always elect a trial over a waiver hearing for payable traffic tickets in Maryland.

You requested a trial or waiver hearing and you failed to appear for that trial date.  When the Judge calls your name and you don’t stand up, the Judge will enter a Failure to Appear for your case. The Court will then notify the MVA that you failed to appear for Court and they will suspend your license or privilege to drive.  You will then have to pay the fine at one of the District Courts in Maryland or you could pay the fine and request a new trial date. You must pay the fine, and you have to pay the full amount for all of the tickets, and then you can request a new trial date.  You must also pay the full fine and request the trial date 120 days from the original trial date.

Failure to Comply Suspension Recall

How to failure to comply suspension recall?  The best and only way to recall a failure to comply suspension recall is to satisfy the fine or court cost with the District Court in which your case was heard.  You can visit any one of the District Courts in Maryland and pay the outstanding fine or costs and the suspension will be recalled.  The Court will notify the MVA and they will lift the suspension and your privilege to drive will be reinstated.  It should happen immediately, but we all know that may not always be the case.  So, if you have resolved an issue and you are stopped by a police officer, make sure you have a receipt showing you have made payment on the outstanding matter.
