What is a DUI or DWI in Maryland?

DUI stands for Driving Under the Influence and DWI stands for Driving While Impaired.  There are differences in Maryland between the two and for simplicity sake, a DUI is more serious than a DWI.  DUI means that you are impaired past the point of .08 in Maryland.  You may ask, what if I did not take the test, how does the Court know that I am a .08?  Often, the State's Attorney and the Courts have seen enough of these cases to know is it is a DUI of DWI based on your actions observed by the police officer before and after the arrest.  A DWI is the lesser of the alcohol offenses and says that you are driving a vehicle or attempting to operate a vehicle while you are impaired.  So, if the Court finds that your action were less than .08 or the reading was less than .08 then you could be convicted of DWI.

What is the penalty for a first offense DUI or DWI in Maryland?

If you are convicted of DUI in Maryland for a first offense, not adding any aggravating factors, then you are facing a maximum penalty of 1 year and $1,000.00 fine or both.  If you are convicted of a DWI in Maryland, not adding any aggravating factors, then the maximum penalty is 60 days and $500.00 fine or both.

This does not take into consideration the MVA consequences on your license and ability to drive in Maryland or the State where you are licensed.
