DUI vs. DWI

Q: What is the difference between a DUI and DWI in Maryland?

A: The difference between a DUI and DWI is one of degrees.   The best way to look at the difference is the driver’s level of intoxication.  If the Court believes you are over .08, the legal limit in Maryland, blood alcohol content (BAC) then they will proceed with a prosecution for DUI.

If they believe you were impaired by not under the influence, under .08 BAC, then the State may proceed on the DWI charge.

There is also a difference in the maximum penalties.  A first offense DUI maximum penalty is a fine of $1,000.00 and 1 year in jail, or both.

The maximum penalty for a DWI in Maryland is a $500.00 fine and 60 days in jail, or both.
